A federal judge in the Northern District of California has issued a nationwide order delaying Homeland Security Secretary Kristi Noem’s decision to revoke the January 2025 extension of the 2023 Venezuela Temporary Protected Status (TPS) designation and its subsequent termination. The ruling comes in the case National TPS Alliance v. Noem (Case No. 3:25-cv-01766), filed on February 19, 2025.
As a result of the court’s decision, Venezuelan nationals covered under the 2023 TPS designation—who were set to lose their benefits on April 7, 2025—will continue to have employment authorization and other TPS protections while the legal challenge unfolds. This reinstates the TPS extension granted by former DHS Secretary Alejandro Mayorkas on January 17, 2025.
The government has appealed the ruling to the Ninth Circuit Court of Appeals and is seeking a stay on the judge’s order.
